There are separate planning applications pending for the two parts of 48 Lauder Road, which is a C-listed villa built around 1875 and sub-divided in 1949 into the ground floor flat (No. 48A) and the first floor flat (No. 48). The house is on the west side of Lauder Road, close to the northern end, at Hatton Place. This is a streetview from July 2008.

The planning application from No. 48 was submitted on 14 December 2018 and the corresponding Listed Building Consent (LBC) application was submitted on 9 January 2019. This is for a ground floor extension to the rear, accessed by an internal stairway from the kitchen of the first floor flat, with a glass balcony at first floor level.

The LBC application from No. 48A and the corresponding planning application were validated on 4 February 2019. This proposes another ground floor extension to the rear, as well as internal reconfiguration. This application, however, indicates a reconfiguration of the garden allocations between the two flats, as this extension is to be built on ground shown in No. 48's application as mutually owned.

Neither the applications from No. 48A nor those from No. 48 show the proposals from the other property and therefore there are no drawings showing the final configuration if both sets of proposals are approved.

The application from No. 48A includes the replacement of part of the front garden with a 6.5m x 4m tarmac hardstanding for a large vehicle, with the removal of the hedge and boundary wall. No. 48 already has a driveway and garage and the proposed new hardstanding would be adjacent to No. 48's driveway, both of which would be ungated.

Following representations from a number of our members and other residents, we have submitted this objection to the proposed tarmac hard standing in front of No. 48A.

The applications from 48 Lauder Road for its rear extension were approved on 7 March 2019. The LBC application from 48A was approved on 19 March 2019 but the handling report for this approval noted that the proposed parking arrangement at the front of the property is not a matter for listed building consent. The planning application remains outstanding and awaiting assessment. Revised drawings have been posted giving more details of the proposed driveway entrance (width 3.6m) and the dropped kerb and which now include a motorised sliding gate. The drawings still show a tarmac surface of 4m x 6.5m.

The planning application for the hard-standing and vehicle run-in has been refused. The Council issued a 'Mixed Decision' on 21 March 2019, granting planning approval for the rear extension but refusing permission for the proposed tarmac hard standing. The handling report is available at 19/00459/FUL and includes:

"The proposed run-in..... would be highly visible. Although run-ins are common on the street, and although some are effectively "double width", none are in front of the main villa. The location of the run-in is considered inappropriate and contrary to policy Env 6.

"Policy Tra 4 is clear that parking should not be "in front of buildings". Although not stipulated, this requirement becomes more critical in cases of listed buildings such as this. The proposal is therefore contrary to policy Tra4."

A new application for Listed Building Consent (LBC) 19/02011/LBC has been submitted for No. 48A. This now shows hard-standing 3m x 7m with an electric charging point. The revised proposal is for the hard-standing to be on the left (southern) side of the site.

There is not yet any corresponding application for planning permission validated for this revised proposal.

The application for planning permission has now been made available on the Council's planning portal as 19/02010/FUL.

The drawings are identical to those for the associated LBC application 19/02011/LBC.

The drawings make clear that the proposal includes the felling of the substantial tree visible in this 2014 streetview behind the disabled parking bay.

The last date for comments to the Council on both the applications is 07 June 2019.

The planning application for the driveway was refused on 11 June 2019. In its handling report, the Council noted:

"The proposal is contrary to the Local Development Plan Policy Env 12 in respect of Trees, as the loss of the tree would be harmful to the character and appearance of the street."

"The loss of the tree is contrary to LDP policy Env12 which seeks to retain trees of importance to the character of the conservation area."

"The tree is semi-mature and in good condition, with many years of life remaining. It makes a visual contribution to the current streetscape and its loss is not justified."

There is now a new application for hard standing, this time proposed at 6.5m x 3m but retaining the tree. Details of the proposals are available on the Council’s planning portal at 19/03448/FUL.

The application includes the installation of a 7kW free-standing electric vehicle charging point.

The last date for comments to the Council's planning department is 30 August 2019.
